You need to be aware that a reduction in your earnings (for example reducing your hours) which reduces your taxable salary to a rate below National Living Wage will not be permitted to be part of the Car Lease Scheme. This would result in the car having to be returned to NHS Fleet Solutions and the Early Termination Fee would apply.

Salary sacrifice FAQs

What is salary sacrifice?

You give up part of your salary and, in return, your employer gives you a non-cash benefit.

Once you accept a salary sacrifice, your overall pay is lower, so you pay less tax, National Insurance and if you’re a member of a Pension scheme, possibly less in Pension contributions.

The Salary Sacrifice will last for an agreed period, specified in your Variation of Contract. At the end of the agreed period, the Variation of Contract will come to an end and you will return to your original terms and conditions.

How is National Minimum Wage calculated for car leasing?

An employee on £14 per hour works 30 hours per week so is paid 130.36 hours per month totaling £1825.04.

Value available to sacrifice based on NMW of £10 per hour is £14 x 130.36 = £521.44. If after receiving the benefit (car) the employee chooses to reduce their hours to 22.5 per week i.e. 97.77 hours per month, then the salary available to sacrifice is only £391.08 (£4 x 97.77). If their benefit has a reduction on salary of £400 they will have to return the benefit (car).

Why am I not eligible for car leasing when my hourly rate is above National Minimum Wage?

National Minimum Wage increases on the 1st April each year and as Agenda for Change pay awards are not guaranteed when the initial assessment is carried out to confirm eligibility for a lease car, we need to ensure you have enough pay to cover the term of the agreement. This ensures (where possible) you are not required to return your benefit and suffer any early return charges.
